1. Acceptance of Terms

By creating an account, accessing, or using Annadata Setu services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, along with our Privacy Policy. If you do not agree, please do not use our platform.

2. Eligibility

To use Annadata Setu, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the platform under applicable laws
• Provide accurate and complete information during registration
• For companies: Be a registered legal entity with valid business documentation
• For farmers: Provide proof of land ownership or cultivation rights

3. Account Registration

When creating an account:

• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access
• We reserve the right to suspend or terminate accounts that violate these terms
• One person or entity may not maintain multiple accounts

4. User Responsibilities

4.1 For Farmers:

• Provide accurate information about crops, quality, and quantity
• Ensure crops meet the specified quality standards
• Honor commitments made to buyers
• Maintain valid documentation of land ownership
• Comply with all agricultural regulations and laws

4.2 For Companies/Buyers:

• Provide accurate product listings and requirements
• Honor pricing and payment commitments
• Maintain valid business registration and licenses
• Process payments in a timely manner
• Comply with food safety and quality standards

5. Platform Usage

Users agree NOT to:

• Use the platform for any illegal or unauthorized purpose
• Post false, misleading, or fraudulent information
• Manipulate prices or engage in price-fixing
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to the platform
• Upload viruses, malware, or harmful code
• Scrape, copy, or extract data without permission
• Impersonate any person or entity
• Interfere with platform operations

6. Product Listings

When posting product listings:

• Information must be accurate and complete
• Images must accurately represent the product
• Pricing must be clear and transparent
• Quality specifications must be honest
• Listings must comply with applicable laws
• Annadata Setu reserves the right to remove inappropriate listings

7. Transactions and Payments

• All transactions are between farmers and companies directly
• Annadata Setu facilitates connections but is not party to transactions
• Payment terms are agreed upon between transacting parties
• Platform fees (if applicable) will be clearly disclosed
• Users are responsible for applicable taxes
• Disputes should be resolved directly between parties

8. Verification Process

Annadata Setu may verify user information through:

• Document verification (ID, business registration, land documents)
• Phone and email verification
• Physical inspection of farms or facilities
• Third-party background checks

Verification does not guarantee the quality, legality, or authenticity of products or transactions.

9. Intellectual Property

All content on Annadata Setu, including but not limited to:

• Platform design, layout, and functionality
• Logos, trademarks, and branding
• Software, code, and algorithms
• Text, graphics, and images

Are owned by Annadata Setu or licensed to us and are protected by intellectual property laws.

10. Limitation of Liability

Annadata Setu is not liable for:

• Quality, safety, or legality of crops or products
• Accuracy of user-provided information
• Actions or omissions of users
• Failed or delayed transactions
• Loss of profits, data, or business opportunities
• Indirect, incidental, or consequential damages
• Natural disasters, acts of God, or force majeure events

Our maximum liability is limited to the amount of fees paid by you in the past 12 months.

11. Dispute Resolution

In case of disputes:

• Parties should first attempt to resolve directly
• Annadata Setu may provide mediation support (optional)
• Unresolved disputes may be escalated to arbitration
• Arbitration will be conducted in New Delhi, India
• Applicable law: Indian Contract Act, 1872 and IT Act, 2000
• Courts in New Delhi shall have exclusive jurisdiction

12. Termination

We may suspend or terminate your account if:

• You violate these Terms and Conditions
• You engage in fraudulent activities
• You provide false information
• Your account remains inactive for extended periods
• Required by law or regulatory authorities

You may terminate your account at any time by contacting support.

13. Modifications to Terms

Annadata Setu reserves the right to modify these Terms at any time. We will notify users of significant changes via:

• Email notifications
• Platform announcements
• Updated "Last Modified" date

Continued use after modifications indicates acceptance of updated terms.

14. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

15. Indemnification

You agree to indemnify and hold Annadata Setu harmless from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your violation of any laws or regulations
• Your infringement of third-party rights
• Your use of the platform

16. Force Majeure

Annadata Setu is not liable for failure to perform obligations due to circumstances beyond our control, including natural disasters, wars, strikes, government actions, or technical failures.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, along with our Privacy Policy and other policies, constitute the entire agreement between you and Annadata Setu regarding platform use.
